Terms and conditions
1.1. Welcome to the MSH website terms and conditions. Please read these terms and conditions carefully before placing your order.
1.2. These terms and conditions apply when you place an order with us via our website mshdesign.co.uk, via trade shows, over the phone, or in our Glasgow showroom.
1.3. By accessing this website and/or placing an order; you agree to be bound by the terms and conditions set out below. Therefore, please read and ensure that you understand them.
1.4. We have the right to amend these terms from time to time - without notice. Any changes will take effect on the date that they are posted to our website; the terms that you approve at the time of your purchase will always be upheld.
2.1. All prices shown in this website are quoted in pounds sterling.
2.2 Data entry errors or other technical problems may result in inaccurate prices being shown. In such cases, we the company are not required to honor this price. If you see any price you believe to be incorrect, please contact us and we can verify the correct pricing.
2.3. The prices we display do not include our delivery charge. When proceeding to the checkout, the total cost of your purchase will be displayed at checkout to include the delivery charge. You can read more about our delivery guidance in section 5.
2.4. From time to time we offer promotions including, but not limited to, discount codes or reduced pricing. These offers are only valid for the time period specified in connection with such events and the terms directly associated to them. Offers cannot be combined with other discounts unless otherwise stated. To use a discount code, the code has to be applied during check out - we cannot apply discount codes post-purchase.
3.1. We have a minimum order value of £100 pre VAT.
3.2. When ordering you will find that items are added to your order in pack sizes. Our pack sizes are as follows:
- Bags and sock boxes (gift set and individual) - Single packs (1).
- One-sized clothing, scarves, bag straps, gloves, hats, and any other accessory - Two packs (2).
- Sized clothing - Minimum of four (4), freedom to customise size combinations. - unless a full size range is unavailable which means the items can be bought in single packs (1).
- Socks - Six packs (6).
3.2. You are considered to have placed an order with us by ordering via our our online checkout process, or if you have placed an order over the phone, at trade shows or in our Glasgow showroom. You are given the opportunity to check your order during these processes to correct any errors that may have occurred.
3.4. You will receive an order confirmation email detailing the products you have ordered along with details of the order value.
3.5. Your order will be processed to our warehouse for fulfilment and dispatch.
3.6. We reserve the right to cancel the order contract if:
- We have insufficient stock to deliver the goods you have ordered.
- We cannot deliver to your area.
- One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we unfortunately have to cancel your order, we will notify you by e-mail and we will re-credit your account within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
4. Payment methods
You can pay for your order using a variety of payment methods.
4.1. You can pay for your order at the time of checkout using a valid debit or credit card. When this order is received, it will be passed onto our warehouse team for fulfilment and dispatch.
4.2. At the time of ordering, customers have the opportunity to select bacs payment. Orders paid via bacs will not be packed until payment is received. Paying by BACs will guarantee a 1.5% discount on your invoice.
4.3. Payment after shipping and delivery will be accepted for our credit customers who have received authorisation to pay for their order within 30 days of the order date.
4.4. Customers who have requested to pay via cash on collection will be required to pay for their order on the day of collection at our offices.
4.5. We offer discounts based on the payment method and timeframe to which our customers pay
- Paying by BACs, you will receive a 1.5%.
- Paying within 10 days, you will receive a 3% discount.
These discounts are reflected on your invoice, and can be used in conjunction to guarantee a 4.5% discount.
5. Shipping and delivery
5.1. You will be informed of the delivery cost at the time of checkout. You can find more information here.
5.2. Whilst we always aim to deliver your order within the communicated delivery time, shipping and delivery may sometimes take longer due to unforeseen circumstances or during our busy periods such as trade show season. We will continue to do our best to get your orders processed as quickly as possible. If your order does not arrive by the estimated delivery date, please contact our customer service team who will be more than happy to help you - our contact information can be found here.
5.3. We will deliver the goods to the address provided by the customer for delivery at the time the order is placed.
5.4. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
5.5. Please be aware that any items sent recorded at your request become the property of you once signed for from the courier. Should an inaccurate signature be given to us, we cannot be held responsible as we have diligently sent the goods to the address given on the order form.
5.6. Purchasers are responsible for any duties and/or taxes levied at the point of entry into the destination country.
5.7. Customers can request to collect their order from our offices, having given us notice of this desire.
6.1, Wholesale buyers can return goods for a full refund for up to 7 days after the day they receive their order.
6.2. Returned items will be inspected and should be returned in the same condition as received. If there is evidence that the contents of an order has been used then the items will be returned to you.
6.3. If you would like to return any goods please either contact us on 0141 959 7362 or email firstname.lastname@example.org stating your original order number and the items you wish to return. We will then contact you to organise the return.
6.4. All returned items will be refunded or credited within 30 days. All credit notes can be used within 6 months of issue on future orders.
7. Defects (faulty items)
7.1. We're sorry to hear if you've had an issue with one of our products. Please contact our customer service team who will take the necessary action to help. Their contact details can be found here.
7.2. Our extended returns policy for retail and wholesale buyers extends only to goods that are damaged or faulty. This does not apply to goods that remain unsold.
7.3. We reserve the rights to approach faulty goods with discretion and on a case by case basis.
7.4. Depending on the information you supply regarding the condition of the item and your request, we will advise next steps. These steps may include.
- The disposal of the item - we will send out a replacement or refund/credit your account depending on your preferred outcome.
- Sending the item back to us for evaluation, to which once in receipt of the item, we will be in contact with next steps.
7.5. If you are required to return an item to us for inspection, your postage will be credited back if sent by Royal Mail 2nd class if the item is deemed to have manufacturing faults or damage.
8. Our Liability
8.1. We make reasonable efforts to ensure that all information we share is accurate, complete and current.
8.2. We take the necessary measures to do our best to accurately displaying and describing our products. However, colours may vary slightly depending on device. Our measurements are based on our size guide; which should be used as an estimate - final measurements may differ per item depending on the material used in its production. If you are unhappy with an item you have received, you can return this item - inline with the returns policy set out in section 5.
8.3. If the goods we deliver are not what you ordered, are damaged, defective, or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address or by email within 7 working days of the delivery of the goods in question.
If you notify us of a problem under this condition, our only obligation will be, at your option:
- To make good any shortage or non-delivery.
- To replace or repair any goods that are damaged or defective.
- To refund to you the amount paid for the goods in question in whatever way we choose.
8.4. MSH will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) whatsoever arising out of any problem you notify to us under this condition. We shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
8.5. We shall have no liability to you for any failure to deliver goods you have ordered, any delay in doing so, or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control. This includes, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
8.5. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. Certain national laws may prohibit the import or export of particular goods. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
8.6. Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
9. Entire agreement
9.1. Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
9.3. If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
9.4. The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
